The opportunities for citizen participation are enshrined in the Basic Law (Art. 20, para. 2, and Art. 28, para. 1). Accordingly, the Federal Republic of Germany is governed by the principle of representative democracy. Decision-making takes place primarily through elected representatives and not directly by the people. Consequently, the election of local councils (municipal councils and county councils) is the most important instrument through which the people directly exercise state authority. Another important opportunity for participation at the local level is provided by the direct election of mayors, county administrators, and village heads.
In addition to the opportunities for participation based on the principle of representation, the Rhineland-Palatinate Municipal Code (GemO) includes several other instruments of participation, some of which are also open to residents who are not eligible to vote (e.g., minors):
Residents’ Meeting:
The residents’ meeting serves to inform residents about important municipal matters and is to be held at least once a year, and otherwise as needed. This is a simple form of citizen participation.
Citizen Initiative and Referendum:
The citizens of a municipality can use a citizen initiative to request a referendum on an important municipal matter. In a referendum, the (voting-eligible) population thus decides on substantive issues itself. The referendum represents the strongest form of citizen participation and overrides the principle of representation. However, a negative list specified in the Municipal Code (GemO) excludes certain areas from being subject to a referendum.
Furthermore, various rights to be heard, to file objections, and to lodge complaints constitute additional elements of citizen participation. At the state level, citizens may also exercise their right to petition the Petitions Committee of the state legislature.
