You can apply for and extend a residence permit for the purpose of employment at this link.
As the holder of a Mobiler ICT card, you can apply for its renewal under certain conditions.
What do I need to know?
Service description
You can renew a Mobiler-ICT card if you wish to continue working as a manager, specialist, or trainee in a German branch of your company.
The requirements for renewal are essentially the same as those for the initial issuance of the Mobile ICT Card, in particular that you can cover your living expenses and health insurance without recourse to public benefits.
The Mobile ICT Card is generally issued for the duration of the intra-corporate transfer. However, the total length of stay in Germany may not exceed three years for executives and specialists and one year for trainees. At the same time, the planned stay in Germany may not be longer than the stay in the EU member state that issued you the residence permit for the purpose of intra-corporate transfer.
As a rule, the Federal Employment Agency must approve the continuation of employment. Approval is obtained by the immigration office.
Prerequisites
In general, to renew your Mobiler-ICT card, you must meet the same requirements as when you first received it, which means:
- You must have a recognized and valid identity document (such as a passport or passport substitute).
- You hold a residence permit from another Member State that is valid for the entire duration of the procedure for the purpose of an intra-company transfer.
- Your company or corporate group has its headquarters outside of Germany and wishes to continue employing you as a manager, specialist, or trainee at a branch in Germany.
- The transfer lasts longer than 90 days in total, but is shorter than your period of residence in another EU member state.
- You can present an employment contract valid for the duration of the transfer and, if necessary, a letter of secondment.
- The Federal Employment Agency has approved the employment (approval is obtained through the Foreigners’ Registration Office), or there is an exemption from the approval requirement for the intended position.
- You can cover your living expenses and health insurance coverage from your income without relying on public benefits.
- The conditions under which you will work in the future are comparable to those of German employees.
- Your wages are equivalent to those of German workers.
- There is no basis for deportation against you.
- Your residence does not endanger or harm the interests of the Federal Republic of Germany.
Procedure
- Find out whether your immigration office allows you to submit your application online or provides a specific application form.
- If you can only apply in person, make an appointment at the Foreigners’ Registration Office. If you apply online, the Foreigners’ Registration Office will contact you after receiving your application to schedule an appointment.
- During the appointment, your identity and documents will be verified (please bring your documents to the appointment—originals if possible).
- If your application is approved, your fingerprints will be taken to produce the Mobile ICT Card (issued in the form of a new electronic residence permit, or eAT card for short). The Foreigners’ Registration Office will commission the Federal Printing Office to produce the Mobile ICT Card. Once the card is ready, you will be notified and can pick it up at the appropriate office. You must pick up the card in person.
- If your application is denied, you will receive a notice of denial.
What else should I know?
- The MobilerICT card will not be issued if the foreign national is expected to stay in Germany for a longer period than in other EU member states as part of an intra-company transfer.
- The ICT Card is issued in all EU member states except Denmark, the United Kingdom, and Ireland. Entry into these countries with an ICT Card is therefore not possible.
